Have I been discriminated against at work?

If the Ivory Tower is the brain of the board, and the Transformers discussion is its heart, then General Discussions is the waste disposal pipe. Or kidney. Or something suitably pulpy and soft, like 4 week old bananas.

I would appreciate some advice about this.

I applied for a job in another dept at my place of work, feeling I was particulalrly suitable for the role and wanting to further my career.

I received a letter back yesterday advising I had not made the interview stages.

I asked for some feedback as to why this was, and I was told over the phone that they loved my application, with my skills matching what they need and my CV and covering letter being very good also.

The reason I was not considered for an interview is because I have had 5 periods of abscence over the last 12 months (1 of which was dependance leave, 2 other periods certified by Doctors)

Is it not discrimination to do this? They said themeselves I was a suitable candidate. I have been punished for being ill. All abscences were certified by my Team leader when I returned to work, I have never been disciplined, written or verbally.

sounds a bit off to me, if all leaves of absence can be accounted for then it doesnt seem right that they can throw it back at you.
Citzens advice can help i belive.

Unfortunately it is their prerogative, and I assure you it would not be difficult for them to come up with a few "valid reasons" why you didn't make the cut and legally back them, though none of said reasons would likely be the real one. Sorry to hear about that Hound. What can I say? Companies suck. You sound like you're suffering the same problem as my friend with the blood disorder. No one wants to hire him be it for a possible liability or due to the fact he may miss work due to illness and there's knowledge of that in advance.

i'm not convinded it is their perogative. I would definitely take advice.

Th eproblem you have is you then want to consider if you wish to persue some kind of legal action if you have a basis.

I think I shall be seeking further advice

2 friends of mine in the company have been promoted within the last 2 months, to much higher posistions than the ones I applied for. And they have both been given verbal warnings for abscence. I havent!!!

The job was actually for a posistion in HR and i was told that HR had to be seen to be sticking to their abscence policies, I need to read the policy again but im pretty sure that unless I have been disciplined it shoudlnt effect me. Its like they want to make an example of me, but what is the point, because my adscences are reasons for are confidential anyway

the sad thing is, if anyone in HR had spoken to either of my team leaders they would have been told how hard working and reliable I was.
